This Privacy  policy for Bricklayer AI Inc. (“we,” “us,” or “our“), describes our policies on how and why we might collect, store, use, disclose, and/or share (“process“)  information about you in connection with your use of our services, including those offered through our websites, and mobile applications (“Service(s)“), such as when you visit  http://www.bricklayer.ai.

When you use the Services, you consent to our collection, use, and disclosure of information about you as described in this Privacy Policy.  If you do not agree with our policies and practices, please do not use our Services. 

  1. WHAT INFORMATION DO WE COLLECT?

In Short: We process information that you disclose to us, as well as certain automatically collected data regarding your use of the Services. We do not collect sensitive personal information.

Personal information you disclose to us. We collect personal information that you voluntarily provide to us when you register for an account on the Services, express an interest in obtaining information about us or our products and services, when you participate in activities on the Services, or otherwise when you contact us. The personal information that we collect depends on the context of your interactions with us and the Services, the choices you make, and the products and features you use. The personal information we collect may include the following:

  • contact data such as first and last names; phone numbers; email addresses, and job titles;

Information automatically collected by us. 

Usage data. We automatically collect certain online activity data when you visit, use, or navigate the Services. This information does not reveal your specific identity (like your name or contact information) but may include device, usage, and location data, such as your IP address, browser and device characteristics, operating system, language preferences, referring URLs, device name, country, location, information about how and when you use our Services, and other technical information. Sensitive Information. We do not collect sensitive information.

In Short: We process your information to provide, improve, and administer our Services, communicate with you, for security and fraud prevention, and to comply with laws. We may also process your information for other legitimate business purposes with your consent.

We will only keep your personal information for as long as it is necessary for the purposes set out in this Privacy Policy, unless a longer retention period is required or permitted by law (such as tax, accounting, or other legal requirements). 

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize such information, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion takes place in accordance with our data retention practices.

Withdrawing your consent.

If we are relying on your consent to process your personal information, which may be express and/or implied consent depending on the applicable law, you have the right to withdraw your consent at any time. However, please note that this will not affect the lawfulness of the processing before its withdrawal nor, when applicable law allows, will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

However, we may still communicate with you — for example, to send you Services-related messages that are necessary for the administration and use of your account, to respond to service requests, or for other non-marketing purposes.

Account Information.

If you would at any time like to review or change the information in your account or terminate your account, you can:

  • Log in to your account settings and update your user account.
  • Upon your request to terminate your account, we will deactivate or delete your account and information from our active databases. However, we may retain some information in our files to prevent fraud, troubleshoot problems, assist with any investigations, enforce our legal terms and/or comply with applicable legal requirements.

Cookies and similar technologies. 

Most Web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove cookies and to reject cookies. If you choose to remove cookies or reject cookies, this could affect certain features or services of our Services. 

  1. CONTROLS FOR DO-NOT-TRACK / GPC FEATURES.

Most web browsers and some mobile operating systems and mobile applications include a privacy control signal or other do-not-track (“DNT”) feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. We do not currently respond to DNT browser signals or any other mechanism that automatically communicates your choice not to be tracked online.

California’s “Shine the Light” Law.

Under certain circumstances, California residents may request and obtain from us, once a year and free of charge, information about categories of personal information (if any) we disclosed to third parties for direct marketing purposes and the names and addresses of all third parties with which we shared personal information in the immediately preceding calendar year. Your rights with respect to your personal information.

Right to request deletion of the data.

You can ask for the deletion of your personal information. If you ask us to delete your personal information, we will respect your request and delete your personal information, subject to certain exceptions provided by law, to protect us or a third party, to fulfill such as (but not limited to) our compliance requirements resulting from a legal obligation, or to conduct any processing that may be required to protect against illegal activities.

Right to be informed.

Depending on the circumstances, you may have a right to know:

  • whether we collect and use your personal information;
  • the categories of personal information that we collect;
  • the purposes for which the collected personal information is used;
  • whether we sell or share personal information to third parties;
  • the categories of personal information that we sold, shared, or disclosed for a business purpose;

As previously mentioned in this privacy policy, we do not process sensitive personal information.

We will not discriminate against you if you exercise your privacy rights.

Process for “Right to Know” requests.

Upon receiving your request, we will need to verify your identity to determine you are the same person about whom we have the information in our system. These verification efforts require us to ask you to provide information so that we can match it with information you have previously provided us. For instance, depending on the type of request you submit, we may ask you to provide certain information so that we can match the information you provide with the information we already have on file, or we may contact you through a communication method (e.g., phone or email) that you have previously provided to us. We may also use other verification methods as the circumstances dictate.

We will only use personal information provided in your request to verify your identity or authority to make the request. To the extent possible, we will avoid requesting additional information from you for the purposes of verification. However, if we cannot verify your identity from the information already maintained by us, we may request that you provide additional information for the purposes of verifying your identity and for security or fraud-prevention purposes. We will delete such additionally provided information as soon as we finish verifying you.

You can designate an authorized agent to make a request under the CCPA on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with the CCPA.

Correction and opt-out.

You may request correction of your personal data if it is incorrect or no longer relevant, or ask to restrict the processing of the information.  You may request to opt out from future selling or sharing of your personal information to third parties for cross-context behavioral advertising. Upon receiving an opt-out request, we will act upon the request as soon as feasibly possible, but no later than thirty (30) days from the date of the request submission.

Right to appeal.

Verification process.

If you are using an authorized agent to exercise your rights, we may deny a request if the authorized agent does not submit proof that they have been validly authorized to act on your behalf.

We may request that you provide additional information reasonably necessary to verify you and your consumer’s request. If you submit the request through an authorized agent, we may need to collect additional information to verify your identity before processing your request.

Upon receiving your request, we will respond without undue delay, but in all cases, within forty-five (45) days of receipt. The response period may be extended once by forty-five (45) additional days when reasonably necessary. We will inform you of any such extension within the initial 45-day response period, together with the reason for the extension.

  1. RESIDENTS OF EUROPE, UK, OR SWITZERLAND 

“European Resident” for purposes of this Privacy Policy means a resident of a country in the European Economic Area (“EEA”), United Kingdom or Switzerland.  For European Residents, please note that the personal information we obtain from or about you may be transferred, processed, and stored outside of the EEA, United Kingdom, or Switzerland for the purposes described in this Privacy Policy, including in the United States of America. We take the privacy of our users seriously and therefore take steps to safeguard your information. These steps include use of Standard Contractual Clauses for transfers of personal information with our third party service providers; further details can be provided upon request.  

These may include the following:

  • To request access to and obtain a copy of your personal information;
  • To request erasure;
  • To restrict the processing of your personal information;
  • To not be discriminated against for exercising your rights;
  • To data portability; and
  • Not to be subject to automated decision-making.
